Aurinko Re operates as a specialized reinsurance MGA and underwriting platform, acting in the distribution, underwriting administration and portfolio management of reinsurance business, subject to applicable delegated authority arrangements and regulatory requirements.

Privacy and Data Protection

In compliance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (General Data Protection Regulation or GDPR) and Organic Law 3/2018, of 5 December, on the Protection of Personal Data and Guarantee of Digital Rights, Aurinko Re informs you about its personal data protection policy.

Source of the Data

We may hold your data because you are or were a client, a contact person, a representative of a client company, a counterparty or a person connected with reinsurance placements, underwriting administration, portfolio management or claims-related processes. Your data may also appear in documentation to which we have had access in the course of providing our services, or in public sources or directories consulted for legitimate business or compliance purposes.

Purpose

With regard to the personal data of our CLIENTS (or their employees), the purpose is to establish and maintain business relationships, support reinsurance placement and underwriting administration, manage portfolio information and amendments, and perform activities related to delegated authority arrangements where applicable. This may include the administration of premiums, settlements, bordereaux, reporting, claims-related support, compliance processes and business communications. In some cases, the data processed may belong to special categories, such as health-related data, where relevant and lawfully permitted.

With regard to THIRD PARTIES, in order to support reinsurance business operations and claims-related processes, we may process personal data of service providers, brokers, cedants, insurers, reinsurers, experts, valuers, legal advisers, IT providers and other business counterparties. We may also process data of affected third parties where this is necessary for the administration, evaluation or handling of claims-related matters.

With regard to our own EMPLOYEES, their data is processed in order to properly manage the employer-employee relationship and, where applicable, to comply with legal obligations.

Legal Basis

For the processing of data relating to CLIENTS (or their employees), the legal basis is usually the performance of a contract, the taking of steps prior to entering into a contract, compliance with legal or regulatory obligations, Aurinko Re’s legitimate interests in carrying out its business, or the express consent of the data subject where required.

In the case of THIRD-PARTY data, the legal basis normally lies in the existence of a contractual relationship, the management of reinsurance and claims-related processes, compliance obligations, Aurinko Re’s legitimate interests in administering its business and protecting its legal position, or express consent where required by law, particularly in the case of special category data.

When it comes to EMPLOYEE data, the existence of the employment contract, legal obligations, and where relevant the express consent of the employee, provide the legal basis for processing.

Recipients

Aurinko Re may disclose personal data, under the security measures required by law and regulation, to public authorities, courts, regulators and supervisory bodies where legally required, and to brokers, cedants, insurers, reinsurers, service providers, professional advisers and other counterparties involved in the performance of our professional activities or internal business operations.

Data Retention Period

We will retain your personal data for as long as necessary for the purposes for which it was collected, including the duration of the contractual or business relationship and any subsequent retention period required by applicable legal, regulatory, accounting, tax or compliance obligations.

Once the applicable retention period has expired, your personal data will be securely deleted or anonymised. Professional contact data may be retained for longer unless we receive a valid objection or erasure request, where legally applicable.

Rights

Data subjects have the right to access their personal data, request rectification of inaccurate or incomplete data, request erasure where appropriate, object to certain processing, request restriction of processing, and exercise their right to data portability where applicable.

You may also object to the processing of your personal data, in which case we will cease processing your data unless there are compelling legitimate grounds or the processing is required for the establishment, exercise or defence of legal claims.

Any dispute arising from the provision of the website service, with express waiver of any other jurisdiction that may apply, shall be submitted to the Courts and Tribunals of Madrid, Spain.
